Barry has been involved in a number of important constitutional and human rights cases concerning the right to a fair trial and police powers of arrest and detention.

 

Reported cases include:

• W v District Judge O'Leary & Director of Public Prosecutions [2010] IESC 63, [2011] 4 IR 544 (Supreme Court considered An Garda Siochana’s duty to seek out and preserve exculpatory evidence and the requirements of re-arresting for the purpose of charging a suspect)

• W v District Judge O'Leary & Director of Public Prosecutions [2007] IEHC 460 (High Court considered An Garda Siochana’s duty to seek out and preserve exculpatory evidence and the requirements of re-arresting for the purpose of charging a suspect)

• Director of Public Prosecutions v Alcock [2007] IESC 60, [2008] 1 IR 200 (Supreme Court considered the extent of An Garda Siochana’s powers of arrest and detention in respect of hybrid offences on foot of a case stated from the District Court)
